Account
After purchasing a user license is the beginning of the business relationship established between you and MailCarry, which will last until your license expires. MailCarry reserves the right to verify the validity of the license at any time, using its own procedures, without affecting your activity in any way.
MailCarry is an online email marketing application that used to distribute emails for advertising purposes. MailCarry does not host the application on its servers, does not sell e-mail databases, and does not create such databases.
Install & Configuration
Once application is delivered, MailCarry doesn’t take responsibility to configure the 3rd party resources, e.g. configuration of mail server or SMTP or integration of a new Gateway etc. Apart from the installation of our application, you will be billed for the services and assistance provided by team MailCarry. If you need configuration or custom development, you are advised to discuss with team MailCarry about the pricing of such services.
- You will not be able to use single user license on more than one computer in a network.
- You aren’t allowed to lease or lend any sublicenses by charging the money or even free of cost. However this does not prevent you to use the application for regular business course.
3rd Party Services
Some modules of this application is dependent on third party software, service or application like Maxmind, Amazon SES, MailGun, SendGrid etc. MailCarry cannot be held responsible for the loss, in case one or more of these services stop functioning.
Spam Policy
We don’t encourage or directly allow spamming in any way or form. Since, MailCarry strictly believe in respecting existing spam-laws/ regulations and policies coined by major email clients to curb the spam, you as our customer agree to use our apps only for sending non-spam, legitimate and solicited emails.
GDPR Compliance
Being a software provider, we always encourage our clients to ensure compliance to the current laws and regulations, as mentioned earlier in this TOS doc about CAN-SPAM or CASL. Since General Data Protection Regulation (GDPR) has been made effective within EU regions, we find it appropriate to make our clients aware of it and make few changes in the TOS docs.
GDPR would apply to all the entities whether in personal capacity or as an organization, collecting and processing the data belonging to EU residents. No matter they belong to a region outside of EU, unless they are collecting and processing the EU residents personal data, GDPR would apply. To keep you out of trouble zone, we would encourage our customers to go through from GDPR and the GDPR consent guidance to its lengths. Here in our TOS, we would outline the important aspects to ensure maximum compliance through this extract.

All copyright related to the creation of the application is and shall remain the property of MailCarry. The violation of these rights may result in criminal and monetary penalties against you.
Note!
We are not liable in any way for the unlawful use of the application or for the content of the transmissions in ways that violate European laws or laws in force in other territories concerning personal data processing.
The users are entirely liable for the ways in which the application is used; MailCarry, as its developers, will not be liable for such uses.
